TERMS AND CONDITIONS (GTC)

1. Contractual partner
Contracts are concluded with Elektro Pelkmann GmbH, Neubeckumer Straße 18, 59269 Beckum, managing directors: Jürgen Teipen & Gabriele Teipen, commercial register number at the Münster district court, HRB 7663, sales tax identification number: DE123988770, e-mail: ecom@elektro-pelkmann.de, telephone number: + 49 (0) 2521 - 93770, fax number: +49 (0) 2521 - 937733.

2. Scope
The following terms and conditions apply to orders via our shop.

3. Consumers and Entrepreneurs
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. Entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

4. Prices
(1) All prices are in euros and include the applicable statutory sales tax.&br; (2) Any shipping costs are borne by the customer, unless the goods are offered free of shipping costs. The shipping costs depend on the shipping method, the weight and the shipping destination. They are displayed with the respective offer.

5. Conclusion of contract
(1) Customers can buy the goods offered by Elektro Pelkmann at a fixed price using the "Buy it now" option. The purchase contract via the "Buy it now option" is concluded when the customer clicks on "Buy it now" for the selected offer and has logged into his account or set up an account or continued as a guest on the then appearing clicks on the "Confirm and pay" or "Pay" button on the overview page with a summary of the essential data on the offer, including the costs incurred. The customer can correct his entries or cancel the purchase process as long as the "Confirm and pay" or "Pay" button on the overview page has not yet been clicked. The customer can also accept offers for several items by placing the items in the shopping cart and completing the immediately subsequent payment process

(2) The contract is concluded exclusively in German.

6. Terms of Payment
The customer can either pay by PayPal or when picking up the goods in the store with the means of payment accepted there. Information on the PayPal payment method can be found on the website of the online provider PayPal.

7. Collection and Shipping
(1) Depending on the payment method, the customer can choose between dispatch of the goods and collection of the goods in the store.
(2) The customer will be notified as soon as the purchased item is ready for collection at the store. When picking up the purchased item in the store, the invoice, the purchase confirmation or the pick-up notification and a valid identification document must be brought with you. If the customer is unable to collect the purchased item himself, he can authorize a third person to do so. Authorization to collect and invoice, purchase confirmation or notification of collection, and valid ID are required for collection.
(3) If the customer does not collect the purchased item within 14 days of receipt of the first notification of collection, Elektro Pelkmann reserves the right to withdraw from the purchase contract for reasons of minimizing storage costs. The customer will be notified of this. He will be credited with the purchase price in the form of the original payment, provided that the purchase price has already been paid.

8. Retention of Title
The goods remain the property of Elektro Pelkmann until full payment has been made.

9. Storage, inspection of the contract text
The customer can view these terms and conditions on the shop. Furthermore, the customer can print out or save these General Terms and Conditions by using the function of his internet browser provided for this purpose. The text of the contract is stored on our website for up to 90 days after the conclusion of the contract and can be viewed by the customer by entering the respective article number. Furthermore, the text of the contract is not saved by Elektro Pelkmann.

10. Warranty
(1) The statutory warranty regulations apply, provided there are no deviations from the following regulations. The statutory warranty claims expire after two years.
(2) When buying a used item, the customer's claims based on the statutory warranty provisions expire in one year.
(3) If the customer buys as an entrepreneur, the claims arising from the statutory warranty provisions are excluded when buying a used item; otherwise, the claims from the statutory warranty provisions become statute-barred in one year.
(4) Excluded from Section 11 (2) and (3) are claims for injury to life, limb or health that are based on a negligent breach of duty by Elektro Pelkmann or an intentional or negligent breach of duty by a legal representative or vicarious agent of Elektro Pelkmann.
(5) The customer's legal claims for defects remain unaffected if there is a guarantee for the goods ordered.
(6) The assignment of claims for defects is excluded unless the customer is a consumer.

11. Liability
(1) Customer claims for damages are excluded. Excluded from this are claims for damages by the customer resulting from injury to life, body and health, as well as liability for other damage based on an intentional or grossly negligent breach of duty by Elektro Pelkmann, its legal representatives or vicarious agents. Liability for the breach of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the customer can regularly rely, remains unaffected. In the case of a slightly negligent breach of these contractual obligations, Elektro Pelkmann is only liable for the contractually typical, foreseeable damage, unless the customer claims for damages resulting from injury to life, limb or health.
(2) Paragraph 1 also applies in favor of the legal representatives and vicarious agents of Elektro Pelkmann if claims are asserted directly against them.
(3) The provisions of the Product Liability Act remain unaffected.

12. Final Provisions
(1) If the customer is an entrepreneur, German law shall apply exclusively, excluding the UN Sales Convention.
(2) For customers who are entrepreneurs, the exclusive place of jurisdiction for all disputes arising from contractual relationships between Elektro Pelkmann and the entrepreneur is the registered office of Elektro Pelkmann.
(3) Should a provision be or become void, the remaining provisions shall remain fully effective. The statutory regulations shall take the place of the ineffective provision, if any.
(4) Elektro Pelkmann is not willing and not obliged to participate in a dispute settlement procedure before a consumer arbitration board.
(5) Online platform for online dispute resolution: We pointed out that the EU Commission has provided an internet platform for the out-of-court settlement of disputes that may arise from purchases made online. The platform of the EU Commission for online dispute resolution can be reached via the link ec.europa.eu/consumers/odr.
